We've recently had a few clients reach out to ask about their website
Privacy Policies and whether their digital PAIA manuals meet the latest
legal standards. Because things are changing quite a bit this year
regarding South African compliance, we wanted to send a quick, friendly
update to all our clients to keep everyone ahead of the curve.
There is a major shift happening right now: for 2026, the Information
Regulator is strictly enforcing mandatory annual PAIA reporting for all
businesses. They are using a new online portal to actively monitor
compliance, and the absolute deadline for submission is 30 June 2026
(with zero extensions being granted).
To make sure your digital platforms are perfectly aligned and your
business is protected, here is a quick, plain-language checklist of what
needs to happen:
1. The 30 June PAIA Portal Deadline
Every business needs to submit an annual return showing if they received
any access-to-information requests over the past year (even if your
number is zero!).
* The First Step: To submit this report, your designated Information
Officer must be registered on the state portal. If you haven't done this
yet, you can register directly on the official Information Regulator
eServices Portal [1].
2. Is your website PAIA Manual up to scratch?
Under Section 51 of the Act, your business must have an accessible PAIA
Manual. Hosting a compliant, electronic version right on your website is
the perfect way to satisfy this legal requirement.
